Podcast Research

As I continue to try to grow my sports social network and music marketing company.  I find that it is important to pay attention to the landscape of all the industry issues that can affect the creation and expansion of my business.  I have review some industry based podcast for up to date knowledge.  In my first podcast I review two podcast from Suffolk University and one from Gordon Firemark on law and video. com .  In my first podcast from Suffolk Universit, Professor Andrew Beckerman talks about the problems that have arise with our current understanding of IP law.  He makes comparison of how and why design patent laws are confusing and somewhat problematic. He talks about the overlapping of trademark law and copyright law.  The problem comes about because a design patent has a limited life span but trademark law can last forever.  In my industry it will be very important for us to comb the industry for complicating design patents to first design what we want our website to look like.  This information was brought to my attention form Professor Andrew talk about how design patents cover anything that can be projected digitally which refer to all websites.  People are protecting there things in a lot of different was which like Prof. Andrew said is affecting the balance new ideas and freedom of those new ideas.

In my second podcast, which was from Gordon Firemark who is a Entertainment lawyer based out of California., He talks about some current event issues like copyright laws and there use in our everyday life.  He makes reference to how copyright laws for photographers of family portraits and family events, and other things like that, can easily be broken.  It is important to understand that the person who takes the photograph actually owns the copyrights to the images.  In some situations people use these photos for commercial and personal use on the Internet.  This issue is very important for my sports social network.  I want to give the users the capability to upload photos.  Some athletes may want to use their user id as a branding tool similar to a twitter account.  This can become a issue if they were to use photos that weren’t taken by them or something that they didn’t have permission to use. As they said in the podcast, “bottom line, get permission for whatever it is that you want to do.

On my third podcast I found another edition by Suffolk University.  In this one Gary C Ganzi, who is a vice president for Siemens Water Co.  He is a named inventor in twenty U.S. patents.  His objective in this podcast was to give the listener a real understanding of how to use the patent system that is currently running in the United States of America.  He urges that patents that aren’t truly valid will destroy the foundation of the patent process.  He brings up the law of obviousness and how some patents that pass this part of the process still shouldn’t qualify for this patent.
He brings up at least three situations were it is clear that insight problem lowers the standards of a patent.  These processes will also become important to our business due to the want to create computer applications to run constantly on the social network.  I must understand what the process will be for creating at idea that we can actually patent to allow lower cost to operate the key features on our website.
Overall it is important for me to start the research and development for some of the ideas that I have, because from the looks of it they are a lot of ideas already out there.
